not.<\/strong><br \/>Work has changed dramatically.<br \/>Employees may now work from home, from co-working spaces, while travelling, or through a combination of office and remote working. Meetings happen on Zoom, Microsoft Teams and Google Meet. Conversations that once took place in corridors and meeting rooms now happen through WhatsApp, email, workplace chat applications and direct messages. But one question remains important:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5be24a9 elementor-widget elementor-widget-text-editor\" data-id=\"5be24a9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Does PoSH apply when the workplace is no longer entirely physical?<\/strong><br \/>The short answer is yes.<br \/>The Prevention of Sexual Harassment (PoSH) framework is not limited to conduct that takes place inside an office building. The legal concept of a workplace is broad, and work-related interactions can extend beyond traditional physical office spaces. For organisations operating remotely or through hybrid models, the question is therefore not simply whether PoSH applies.<br \/>The real question is:<br \/><strong>How effectively has the organisation adapted its PoSH framework to the realities of <\/strong><strong>digital work?<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3e4c7ed elementor-widget elementor-widget-text-editor\" data-id=\"3e4c7ed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>1. The Workplace Has Changed \u2014 But the Responsibility <\/strong><strong>Hasn&#8217;t<\/strong><br \/>A physical office makes it easy to identify the workplace. There is a building, a desk, a meeting room and colleagues working together. Remote work changes this equation. An employee may be sitting at home while attending a work meeting. A manager may communicate with a team member through a private message. A team may interact through a virtual meeting late in the eveningThe physical location may have changed. The professional relationship has not. Therefore, organisations should not assume that conduct occurring through a digital platform automatically falls outside the PoSH framework. What matters is the nature of the conduct, the circumstances in which it occurred, and its connection with the workplace or employment relationship.<br \/><br \/><strong>2. Can Online Conduct Amount to Sexual Harassment?<\/strong><br \/><strong>Yes.<\/strong><br \/>Sexual harassment does not necessarily require physical contact.<br \/>Depending on the circumstances, inappropriate conduct may occur through:<br \/>\u2022 Video calls and virtual meetings<br \/>\u2022 Emails<br \/>\u2022 WhatsApp or other messaging platforms<br \/>\u2022 Workplace chat applications<br \/>\u2022 Social media interactions connected with work<br \/>\u2022 Inappropriate images, GIFs, memes or messages<br \/>\u2022 Sexual comments during virtual meetings<br \/>\u2022 Unwelcome personal or sexual communications<br \/>\u2022 Repeated unwanted invitations or advances<br \/>\u2022 Inappropriate conduct during online work events<br \/>The medium may have changed.<br \/>The nature of the conduct and its connection with the workplace are what matter. An organisation should therefore assess the substance and context of a complaint rather than dismissing it simply because the interaction happened online.<br \/><br \/><strong>3. What About a Private Message?<br \/><\/strong><br \/>This is where matters can become more complicated Imagine an employee receives repeated personal messages from a colleague outside normal working hours.Over time, the messages become increasingly personal and sexual in nature.The employee has not welcomed these communications.Does the fact that the messages were sent to a personal phone automatically make the matter purely personal? Not necessarily.<br \/>The Internal Committee (IC) would need to examine the circumstances, including:<br \/>\u2022 The relationship between the parties<br \/>\u2022 The context of the communication<br \/>\u2022 Whether the communication was connected with employment or workplace<br \/>interaction<br \/>\u2022 The nature and frequency of the messages<br \/>\u2022 Whether the conduct falls within the applicable legal framework<br \/>The important lesson is simple:<br \/>Don&#8217;t decide based only on the platform. Examine the context. A personal device or messaging application does not, by itself, determine whether conduct has a workplace connection.<br \/><br \/><strong>4. What If the Incident Happens During a Video Call?<\/strong><br \/>Virtual meetings are now part of everyday professional life. Consider a situation where an employee makes an inappropriate sexual comment about a colleague during a team video call.<br \/>Or someone makes an inappropriate gesture on camera. Or an employee receives unwelcome sexual remarks during a one-to-one virtual meeting. The fact that everyone is sitting in different locations does not automatically remove the workplace context.<br \/>For an IC, the inquiry may involve examining relevant material such as:<br \/>\u2022 Meeting invitations<br \/>\u2022 Chat messages<br \/>\u2022 Emails<br \/>\u2022 Screenshots<br \/>\u2022 Recordings, where lawfully available<br \/>\u2022 Witness accounts<br \/>\u2022 Follow-up communications<br \/>\u2022 Relevant organisational policies<br \/>Digital workplaces can therefore create digital evidence trails that may become relevant during an inquiry. At the same time, digital evidence must be handled carefully and evaluated in accordance with applicable law, organisational policy and principles of fair inquiry.<br \/><br \/><strong>5. Remote Work Does Not Mean \u201cNo Boundaries\u201d<\/strong><br \/>One of the biggest challenges in remote workplaces is the blurring of professional and personal boundaries. Employees may communicate at unusual hours.<br \/>They may use personal devices.<br \/>They may interact informally through messaging applications.<br \/>They may work with colleagues whom they have never physically met.<br \/>These circumstances can create confusion about what constitutes appropriate professional communication.<br \/>Organisations should therefore establish clear expectations around:<br \/>\u2022 Professional communication<br \/>\u2022 Digital conduct<br \/>\u2022 Appropriate use of messaging platforms<br \/>\u2022 Virtual meetings<br \/>\u2022 After-hours communication<br \/>\u2022 Online workplace events<br \/>\u2022 Appropriate professional boundaries<br \/>PoSH awareness should evolve along with the way employees work.<br \/>Employees need to understand that working remotely does not mean that professional<br \/>standards disappear.<br \/><br \/><strong>6. What Should an Internal Committee Do Differently?<\/strong><br \/>The fundamental principles of a PoSH inquiry do not disappear simply because the workplace has become digital. However, an IC may need to consider additional forms of evidence, communication and<br \/>procedural safeguards. <br \/><strong>Digital Evidence<\/strong><br \/>Messages, emails, screenshots, meeting records and other relevant material may form part of the evidence, subject to applicable law and procedure.<br \/><strong>Online Witnesses<\/strong><br \/>A witness may be located in another city or even another country. The IC may therefore need to conduct interactions virtually while ensuring that the process remains fair and confidential.<br \/><strong>Confidentiality<\/strong><br \/>Remote inquiries create additional risks involving screenshots, recordings, shared documents, personal devices and unauthorised access.<br \/><strong>Documentation<\/strong><br \/>Virtual meetings, communications and procedural steps should be documented carefully and appropriately.<br \/><strong>Neutrality<\/strong><br \/>Digital communications must be evaluated objectively. A single message should not automatically be treated as conclusive proof of intent or misconduct without considering its context and the surrounding evidence. The technology may be different. The principles of a fair inquiry remain the same.<br \/><br \/><strong>7. Confidentiality Becomes Even More Important Online<\/strong><br \/>Confidentiality is a fundamental aspect of the PoSH process.Remote working can create additional challenges. Imagine an IC member discussing an ongoing complaint from a home environment while other people are nearby. Or an inquiry document being downloaded onto a personal device. Or confidential screenshots being forwarded unnecessarily. These situations can create avoidable confidentiality risks.<br \/>IC members and organisations should therefore be particularly careful about:<br \/>\u2022 Where confidential discussions take place<br \/>\u2022 Who can access inquiry documents<br \/>\u2022 How evidence is stored<br \/>\u2022 Whether documents are shared through secure channels<br \/>\u2022 Whether meetings are recorded<br \/>\u2022 Who has access to recordings or screenshots<br \/>\u2022 What information is communicated to witnesses<br \/>Digital convenience should never come at the cost of confidentiality.<br \/><br \/><strong>8. What Should Employers Do?<\/strong><br \/>A remote or hybrid organisation should not simply copy its physical workplace PoSH practices and assume they are sufficient. Employers should periodically review whether their PoSH framework addresses the realities of digital work.<br \/>Consider asking:<br \/>\u2022 Does our PoSH policy address digital workplace conduct?<br \/>\u2022 Do employees know how to report an incident that happens online?<br \/>\u2022 Do employees know who the Internal Committee members are?<br \/>\u2022 Can employees access the complaint mechanism remotely?<br \/>\u2022 Are IC members trained to handle digital evidence?<br \/>\u2022 Are confidentiality and data-access protocols clear?<br \/>\u2022 Does PoSH training include examples involving remote and hybrid work?<br \/>\u2022 Do managers understand how to respond when concerns are reported?<br \/>If the answer to these questions is \u201cno\u201d, there may be a gap between having a PoSH<br \/>framework and having an effective PoSH framework.<br \/><br \/><strong>9. Don&#8217;t Make the Mistake of Saying: \u201cIt Happened <\/strong><strong>Online, So It Is Not Our Problem.\u201d<\/strong><br \/>This can be a dangerous assumption for an organisation to make. A digital interaction can still have a workplace connection. An organisation should not dismiss a complaint merely because the conduct occurred<br \/>through:<br \/>\u2022 WhatsApp<br \/>\u2022 Email<br \/>\u2022 Zoom<br \/>\u2022 Microsoft Teams<br \/>\u2022 A phone call<br \/>\u2022 A social media platform<br \/>\u2022 Another digital communication channel<br \/>Instead, the organisation should examine the facts and determine whether the conduct fallswithin the applicable PoSH framework.Platform \u2260 Context The fact that an interaction occurred on a particular platform does not, by itself, answer the legal question. Context matters.<br \/><br \/><strong>10. The IC Needs to Adapt Without Losing Its Core Principles<\/strong><br \/>Remote and hybrid workplaces require new ways of working. But the core responsibilities of an Internal Committee remain. The IC must continue to uphold:<br \/>\u2022 Fairness<br \/>\u2022 Neutrality<br \/>\u2022 Confidentiality<br \/>\u2022 Impartiality<br \/>\u2022 Proper documentation<br \/>\u2022 A meaningful opportunity for both parties to present their case<br \/>Technology may change how an inquiry is conducted. It should never change the commitment to conducting that inquiry fairly.
